Important Notice About AI-Generated Content

YourNiceCv uses artificial intelligence (AI) to assist with resume creation, editing, and content generation. This disclaimer explains how AI is used, its limitations, and your responsibilities when using AI-generated content.

Please read this carefully before using AI features.

1. How We Use AI

YourNiceCv integrates Google Gemini API (a large language model developed by Google LLC) to provide the following features:

1.1 Resume Parsing and Import

When you upload a PDF or DOCX resume:

  • ✅ AI extracts text from your file
  • ✅ AI identifies and structures data (name, email, work experience, education, skills)
  • ✅ AI normalizes formatting into a standardised resume format

Purpose: Convert unstructured documents into editable, structured data.

1.2 Resume Tailoring

When you provide a job description:

  • ✅ AI analyzes the job requirements
  • ✅ AI suggests modifications to your resume (keywords, skills, phrasing)
  • ✅ AI generates a customised version optimised for the specific role

Purpose: Increase relevance of your resume for targeted job applications.

1.3 Cover Letter Generation

When you request a cover letter:

  • ✅ AI drafts a personalised cover letter based on your resume and job details
  • ✅ AI matches your experience to job requirements
  • ✅ AI generates professional tone and structure

Purpose: Save time creating tailored cover letters.

1.4 Content Suggestions

As you edit:

  • ✅ AI may suggest improvements to wording, grammar, or formatting
  • ✅ AI may recommend additional skills or keywords

Purpose: Enhance resume quality and professionalism.

1.5 Your Rights with Automated Decisions (UK GDPR/GDPR Article 22)

UK Data Protection Law: Automated Decision-Making

Under UK GDPR (Data Protection Act 2018) Article 22 and EU GDPR Article 22, you have specific rights regarding automated decision-making and profiling:

What is Article 22?

Article 22 protects individuals from decisions based solely on automated processing (including profiling) that produce legal or similarly significant effects.

Your Rights Under Article 22

You have the right to:

  1. Not be subject to solely automated decisions: No decision that significantly affects you should be made without human involvement
  2. Human review: Request human intervention in the decision-making process
  3. Express your point of view: Challenge the automated decision
  4. Obtain an explanation: Understand the logic, significance, and consequences of automated processing
  5. Contest the decision: Object to the automated decision and request reconsideration

How This Applies to YourNiceCv

YourNiceCv AI does NOT engage in Article 22 automated decision-making because:

  • AI does not make decisions on your behalf — it generates suggestions only
  • Human-in-the-loop required — you must explicitly review and approve all AI-generated content
  • No legal or similarly significant effects — AI suggestions do not automatically affect your employment, credit, legal status, or rights
  • Full user control — you can edit, reject, or delete any AI output

Example: If AI generates a resume, it does NOT automatically submit it to employers. You must:

  1. Review the AI-generated content
  2. Edit and personalise it
  3. Manually decide whether to use it
  4. Manually submit it to employers

However, if you believe AI processing has significantly affected you: Contact privacy@yournicecv.com to request:

  • ✅ Human review of AI suggestions
  • ✅ Explanation of how AI processed your data
  • ✅ Manual override or correction of AI output

Transparency in AI Processing (UK GDPR/GDPR Article 13)

Under UK GDPR Article 13 (information to be provided to data subjects), we must inform you:

What AI processes:

  • Resume text content (name, work history, skills, education)
  • Job description text (for tailoring features)
  • Your prompts and instructions

How AI makes decisions:

  • AI uses natural language processing (NLP) to analyse text patterns
  • AI compares your resume to job requirements to suggest keywords
  • AI generates text based on statistical patterns in training data

Significance and consequences:

  • AI output may influence your job application success
  • Employers may reject AI-generated content if detected
  • You are responsible for verifying AI accuracy

Third-party processor: Google Gemini API (Google LLC) processes your data as a data processor under a Data Processing Agreement (DPA)

You retain full control: You can always choose not to use AI features and edit resumes manually.

2. What AI Is NOT

YourNiceCv's AI is NOT:

  • ❌ A professional resume writer or career coach
  • ❌ A substitute for human judgment and expertise
  • ❌ A guarantee of job interviews or offers
  • ❌ Capable of understanding your unique career goals and context
  • ❌ Liable for any outcomes from your use of AI-generated content

AI is a tool to assist you — not replace your own review and decision-making.

3. Limitations of AI-Generated Content

AI technology has inherent limitations. Content generated by Gemini API may:

3.1 Accuracy Issues

  • ⚠️ Contain factual errors (e.g., incorrect dates, misinterpreted job titles)
  • ⚠️ Misrepresent your experience (e.g., exaggerate skills, add qualifications you don't have)
  • ⚠️ Include outdated information (AI training data has a knowledge cutoff)

Example: AI might infer you have a certification you never mentioned, or miscalculate years of experience.

3.2 Contextual Misunderstanding

  • ⚠️ Fail to understand nuance (e.g., industry-specific terminology, company culture)
  • ⚠️ Misinterpret your intentions (e.g., suggest a career pivot you didn't intend)
  • ⚠️ Overlook important details (e.g., ignore key achievements from your original resume)

Example: AI might emphasize technical skills when you're applying for a management role.

3.3 Generic or Unoriginal Content

  • ⚠️ Generate "template-like" text that sounds robotic or impersonal
  • ⚠️ Use clichés or buzzwords excessively (e.g., "team player", "results-driven")
  • ⚠️ Lack your unique voice and personality

Example: AI-generated cover letters may sound formulaic and fail to stand out.

  • ⚠️ Potentially reproduce copyrighted text from training data (though rare)
  • ⚠️ Generate content similar to other users' AI-generated resumes
  • ⚠️ Lack originality (employers may recognize AI-generated patterns)

Risk: Some employers use AI detection tools and may reject AI-generated applications.

3.5 Bias and Discrimination

  • ⚠️ Reflect biases present in training data (e.g., gender, racial, age bias)
  • ⚠️ Inadvertently generate discriminatory language (e.g., age-related assumptions)
  • ⚠️ Favor certain industries, job types, or backgrounds over others

Example: AI might assume leadership roles require "aggressive" language (gender-biased phrasing).

3.6 Hallucinations (False Information)

AI may "hallucinate" — generate plausible-sounding but entirely false information:

  • ⚠️ Invent company names, job titles, or certifications
  • ⚠️ Fabricate statistics or accomplishments
  • ⚠️ Create realistic but fake references

Critical: Always fact-check AI output against your actual experience.

4. Your Responsibilities

By using AI features, you agree to:

✅ Review All AI Output Carefully

  • Never submit AI-generated content without thorough review
  • Check for factual accuracy, grammar, and tone
  • Ensure content reflects your actual qualifications and experience

✅ Verify Factual Accuracy

  • Confirm all dates, job titles, companies, and achievements are correct
  • Cross-check against your original resume or records
  • Remove any information AI added that is not true

✅ Personalize AI Content

  • Add your unique voice, examples, and personality
  • Remove generic phrases and clichés
  • Tailor content to your specific situation (AI cannot know everything about you)

✅ Ensure Truthfulness

  • Do NOT use AI to fabricate qualifications, experience, or credentials
  • Be honest in all job applications (misrepresentation can lead to termination or legal issues)
  • If AI suggests something inaccurate, correct it or remove it

✅ Comply with Employer Requirements

  • Some employers prohibit AI-generated application materials
  • Check job posting guidelines before using AI content
  • Disclose AI use if required by the employer
  • You are legally responsible for all content in your resume and cover letter
  • Submitting false information can result in:
    • ❌ Job offer rescission
    • ❌ Termination for cause (if hired)
    • ❌ Legal liability (fraud claims in extreme cases)
    • ❌ Damage to professional reputation

5. Disclaimers and Limitations of Liability

READ CAREFULLY — THIS SECTION LIMITS OUR LIABILITY.

5.1 No Warranties

AI-GENERATED CONTENT IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, including but not limited to:

  • ❌ Warranties of accuracy, completeness, or reliability
  • ❌ Warranties of fitness for a particular purpose (e.g., landing a job)
  • ❌ Warranties of non-infringement (plagiarism-free)
  • ❌ Guarantees that AI output will meet employer expectations or ATS requirements

5.2 No Liability for AI Errors

WE ARE NOT LIABLE FOR:

  • ❌ Factual errors, omissions, or inaccuracies in AI output
  • ❌ Lost job opportunities due to AI-generated content
  • ❌ Rejected applications or failed interviews
  • ❌ Damage to your professional reputation
  • ❌ Employer penalties (e.g., blacklisting, termination) for AI use
  • ❌ Legal claims arising from AI-generated content (e.g., fraud, misrepresentation)

5.3 Third-Party AI Provider (Google Gemini API)

Google Gemini API is a third-party AI service provided by Google LLC (United States).

Data Processing Relationship (UK GDPR Compliance)

Under UK GDPR/GDPR:

  • YourNiceCv is the data controller (determines purposes and means of processing)
  • Google LLC is the data processor (processes data on our behalf)
  • A Data Processing Agreement (DPA) is in place as required by UK GDPR Article 28

What Data Google Processes

When you use AI features, the following data is sent to Google Gemini API:

  • ✅ Resume text content (name, contact info, work history, education, skills)
  • ✅ Job description text (for tailoring)
  • ✅ Cover letter drafts
  • NOT sent: Passwords, payment information, analytics data

Data Location and International Transfers

  • Google Cloud infrastructure: Global (US, EU, Asia data centres)
  • UK users: Data transfers to Google (US) are protected by:
    • UK-approved Standard Contractual Clauses (SCCs)
    • Google Cloud Data Processing Amendment (DPA)
    • Encryption in transit and at rest

Google's commitments:

  • ✅ UK GDPR and EU GDPR compliant
  • ✅ SOC 2 Type II, ISO 27001 certified

We ARE responsible for:

  • ✅ Selecting a UK GDPR-compliant AI provider
  • ✅ Ensuring Data Processing Agreement is in place
  • ✅ Informing you about AI data processing (transparency)
  • ✅ Respecting your data protection rights

Your Data Protection Rights with AI Processing

Even when Google processes your data as a processor, you retain UK GDPR rights:

  • Access: Request what data Google processed via AI
  • Erasure: Request deletion of your data from Google's systems (via us)
  • Rectification: Correct inaccurate AI-processed data
  • Object: Object to AI processing (use manual editing instead)
  • Restrict processing: Limit how AI uses your data

To exercise rights: Contact privacy@yournicecv.com — we will coordinate with Google as your data processor

We are not liable for:

  • ❌ Google Gemini service failures or downtime
  • ❌ Google's AI output quality or errors (see Section 5.2)
  • ❌ Google's compliance failures (though we monitor DPA compliance)

5.4 Indemnification

You agree to indemnify and hold harmless YourNiceCv and its operators from any claims, damages, or legal costs arising from:

  • ✅ Your use of AI-generated content
  • ✅ Misrepresentation in job applications using AI content
  • ✅ Employer claims of fraud, plagiarism, or false credentials
  • ✅ Violation of employer policies regarding AI use

In plain English: If you submit a resume with AI-generated false information and get sued or fired, you cannot blame us. You are responsible.

6. Best Practices for Using AI Features

To get the best results and minimize risks:

✅ Use AI as a Starting Point, Not Final Output

  • Generate draft content with AI
  • Edit heavily to add your personality and accuracy
  • Treat AI as a "first draft" assistant

✅ Fact-Check Everything

  • Verify dates, job titles, company names
  • Confirm all skills and certifications are accurate
  • Remove AI-invented details

✅ Customize for Each Job

  • Don't send the same AI-generated resume to every employer
  • Tailor content manually based on job requirements
  • Add specific examples and achievements

✅ Proofread Multiple Times

  • Check grammar, spelling, and formatting
  • Read aloud to catch awkward phrasing
  • Ask a friend or mentor to review

✅ Run Through ATS Scanners (Optional)

  • Use third-party ATS checker tools (e.g., Jobscan, Resumatch)
  • Ensure keywords match job description
  • Test formatting for ATS compatibility

✅ Keep a "Master Resume"

  • Maintain a separate, comprehensive resume with all your experience
  • Use AI to create tailored versions from the master
  • Always reference the master for accuracy

7. When NOT to Use AI Features

Avoid using AI in these situations:

Job applications that explicitly prohibit AI

  • Some employers require "original, non-AI-generated content"
  • Violating this rule may disqualify you

High-stakes applications (executive roles, security clearances, legal positions)

  • Errors in AI output could have serious consequences
  • Manual, professionally-written resumes are safer

If you don't understand your own field well enough to review AI output

  • AI may generate plausible but incorrect industry terminology
  • You must be able to spot mistakes

If you're uncomfortable with AI-generated content

  • Use manual editing features instead
  • AI is optional — not mandatory

8. AI Transparency and Ethics

8.1 Our Commitment

We are committed to:

  • ✅ Transparency about AI use (this disclaimer)
  • ✅ Clearly labeling AI-generated content in the app
  • ✅ Providing manual editing options (AI is optional)
  • ✅ Continuous monitoring of AI output quality

8.2 Reporting Issues

If you encounter problematic AI output:

We take AI safety seriously and will investigate all reports.

8.3 AI Model Updates

Google may update Gemini API models over time:

  • ✅ Improvements may enhance accuracy and quality
  • ⚠️ Changes may affect output style or content
  • ✅ We do NOT control Google's model updates

We will notify users of significant AI changes via email or in-app announcements.

9. Employer Perspective on AI Use

Be aware: Many employers are developing policies on AI-generated job applications.

Some employers:

  • Allow AI use (as long as content is accurate and personalized)
  • ⚠️ Discourage AI use (prefer human-written applications)
  • Prohibit AI use (may use AI detection tools)

Our advice:

  • ✅ Read job postings carefully for AI policies
  • ✅ When in doubt, personalize AI content heavily (hard to detect)
  • ✅ Be prepared to discuss your resume in interviews (know your content inside-out)

Do NOT:

  • ❌ Submit unedited AI output (obvious to reviewers)
  • ❌ Lie about using AI if asked
  • ❌ Rely solely on AI without understanding the content

10. Future of AI in YourNiceCv

We may introduce additional AI features:

  • 🚀 Job matching (AI recommends jobs based on your resume)
  • 🚀 Interview prep (AI generates practice questions)
  • 🚀 ATS optimization (AI checks resume against ATS algorithms)

If we add new AI features:

  • ✅ This disclaimer will be updated
  • ✅ Users will be notified of new AI capabilities
  • ✅ Opt-out options will be available (where feasible)

11. Alternatives to AI Features

If you prefer NOT to use AI, you can:

  • ✅ Create resumes manually using templates
  • ✅ Upload existing resumes and edit them manually
  • ✅ Use our formatting and design tools (no AI involved)
  • ✅ Export templates to edit in Word/Google Docs

AI features are optional — you have full control over whether to use them.

IN SUMMARY:

  1. AI is a tool — not a replacement for human judgment
  2. ⚠️ AI makes mistakes — always review and fact-check
  3. We are not liable for AI errors, rejected applications, or consequences of AI use
  4. You are responsible for all content you submit to employers
  5. ⚠️ Use ethically — do not fabricate qualifications with AI

If you do not agree with these terms, do NOT use AI features. Use manual editing instead.
